An appeal against the seizure of horses from the Wetlands area in Kilkenny last February can now go ahead in the District Court.
It follows proceedings in the High Court today where the state conceded to an argument put forward by Barrister Michael Lanigan. He argued that it was against the constitution and the European Convention on Human Rights.
Last February, 14 horses were seized by approximately 40 gardai and members of the armed response unit as they did not comply with micro-chipping and passport requirements.
A short time later, 15 horses were seized from Daly’s Hill on the Circular road.
The State had been challenging the right of the district court to hear the appeal in today’s High Court proceedings before Justice Egar, but this appeal can now go ahead after the state conceded.
The state also agreed to cover any legal costs arising from the High Court proceedings.
The horses will continue to be cared for until the appeal is heard.
